By accessing the Platform and/or using the Services, you agree to comply with these Terms of Use. If you do not agree with these Terms of Use, please refrain from accessing and/or using the Platform or Services.
These Terms of Service (“Terms”) govern your use of the websites, mobile applications, and services (collectively, the “Services”) provided by Talata (as defined below).
1. General
These Terms apply to all users of the Services, including but not limited to sellers, buyers, and anyone contributing content, information, or other materials. If you are entering into this agreement on behalf of a business entity, the term “you” refers to that business entity, unless the context indicates otherwise.
These Terms are between you and Talata, or any other service provider identified for a specific Service. For simplicity, Talata and its subsidiaries are referred to collectively as “Talata” in these Terms.
By using the Services in any form, including visiting or browsing the Services, you agree to comply with and be bound by these Terms, as well as any additional terms, conditions, or policies referenced herein or available via hyperlinks.
Talata reserves the right to update or modify these Terms at any time. Your continued use of the Services after any such changes are posted will be considered your acceptance of those changes.
All intellectual property related to the Talata website and application, including content, services, and platforms, belongs solely to Talata. Users have limited and revocable privileges over the content they post, and ownership of user-submitted content remains with the user or relevant authorities. If a user acts on behalf of a business or organization, they confirm they have the authority to bind the organization to these terms and conditions.
2. Use of the Services
Subject to your compliance with these Terms, Talata grants you a limited, non-exclusive, revocable (with or without cause), non-transferable right and license to use the Services.
You agree to use the Services in accordance with these Terms and shall not:
- Upload or share any content that infringes upon or violates the rights of another party, including publicity, privacy, copyright, trademark, or other intellectual property rights.
- Copy, decompile, reverse engineer, disassemble, attempt to derive the source code, decrypt, interfere with, or disrupt the performance or integrity of the Services.
- Modify, adapt, improve, enhance, translate, or create derivative works from the Services.
- Violate any applicable laws, regulations, or rules in connection with your access to or use of the Services.
- Use the Services in a way that violates or circumvents any sanctions or embargoes.
- Remove, alter, or obscure any proprietary notices (including copyright and trademark) of Talata, its affiliates, partners, suppliers, or licensors.
- Use the Services for any purposes other than those for which they are designed or intended.
- Use the Services to create or promote products, services, or software that competes with or substitutes Talata’s Services or any offerings by Talata.
- Use any proprietary information or intellectual property of Talata in designing, developing, manufacturing, licensing, or distributing applications, accessories, or devices that interact with the Services.
- Send, post, or communicate content that is false, offensive, indecent, threatening, abusive, insulting, harassing, defamatory, deceptive, fraudulent, obscene, invasive of privacy, or otherwise objectionable.
- Use the Services to send unsolicited, automated, or unauthorized advertising, promotional material, or any form of spam, junk mail, or chain letters.
- Upload or transmit files, data, or links that contain or redirect to viruses, Trojans, worms, or other harmful components.
- Use automated devices such as scrapers, bots, crawlers, or other means to access, acquire, copy, or monitor any part of the Services or its content.
- Collect any user information without their consent.
- Attempt to avoid paying applicable fees and charges.
- Engage in any activity intended to exploit, abuse, or manipulate promotions, campaigns, or discount codes, such as creating fake accounts, generating fake orders, or reselling your own inventory.
- Upload, post, or communicate any content that falsely claims to be part of a program offered by Talata, including misrepresenting a listing as part of a verified or certified program.
- Use the Services in a way that could present Talata with risks of non-compliance with anti-money laundering, counter-terrorist financing, or other regulatory requirements.
You are also prohibited from authorizing or encouraging others to perform any of the actions listed above.
Talata reserves the right to retract any rewards, cashbacks, prizes, or other benefits paid to you under promotions or campaigns and may suspend or terminate your account if you are found or suspected of breaching these Terms, any policies, or any additional guidelines.
You are required to always comply with relevant financial recordkeeping, reporting requirements, and anti-money laundering statutes in all applicable jurisdictions, as well as any related rules or regulations enforced by governmental authorities.
3. Account
To access certain features of the Services, you must create an account with Talata (“Account”). By creating an Account, you represent and warrant that:
- You are capable of entering into and fulfilling legally binding contracts under applicable law.
- All information you provide is accurate, current, truthful, and complete.
If you are under 20 years of age, you may only use the Services with the consent and supervision of your parent or legal guardian, who will be responsible for your activities.
You are responsible for all activities and transactions under your Account. Talata will not be held liable if your password and/or Account are misused or accessed by a third party. Therefore, you agree to:
- Keep your password secure.
- Ensure your account information is always up to date.
- Follow Talata’s current policies and guidelines and comply with all applicable laws regarding your activities and the Content you upload to the Services.
Unless expressly allowed by Talata and subject to these Terms, as well as any additional terms set by Talata, you may not create multiple Accounts.
You must not:
- Lend, transfer, or sell your Account or user ID to anyone else.
- Use another user’s Account without their permission.
Talata reserves the right to suspend or terminate your Account(s) or restrict access to the Services at any time, without prior notice.
Talata also reserves the right to consolidate multiple Accounts created by the same user, whether authorized by Talata or not. This includes the right to treat the funds across multiple Accounts as a single account and to use any funds in those Accounts to settle debts, payments, and refunds.
4. Listing Rules and Prohibited Items
4.1 The user is required to adhere to the listing guidelines established by Talata, in accordance with Talata’s rights and policies. For more details, please refer to our Listing Rules and Prohibited Items section.
4.2 The user is solely responsible for ensuring that all information, images, and details related to products or services (including, but not limited to, photos, images, or other content) posted on Talata’s website and applications are owned by the user and are legally under their full control, or that the user has obtained the necessary legal rights to use such content.
4.3 The user is prohibited from utilizing or publishing any images or information that are reused, modified, or copied whether partially or entirely without the explicit permission of the rightful owner or from other sources or websites that are not owned by the user. The user will bear sole responsibility for any claims, damages, or legal issues arising from the use of such data, images, and information if they infringe upon the rights of third parties.
4.4 The user acknowledges that the information, images, and details shared on Talata’s website and application are not confidential and are publicly accessible. Therefore, Talata is not bound by privacy policies or responsible for any content belonging to third parties, nor is Talata liable for any losses or damages caused to third parties as a result. If Talata determines, or reasonably suspects, that the user has violated any of the above rules or requirements, Talata reserves the right, at its sole discretion, to delete, suspend, or modify the user’s listing or content, and to block the user’s account or access to the platform, without prior notice.
4.5 The dissemination or posting of false information, or actions that violate the rights or reputations of others, is considered the sole responsibility of the user, and Talata will not be held accountable for such actions. The user agrees that Talata is not liable for any legal consequences resulting from such conduct.
5. Unauthorized Access and Use of Data
5.1 Talata’s website, application, and computer systems are secured with specific access measures and protected under applicable computer crime laws.
5.2 Users are prohibited from accessing Talata’s website and systems illegally, causing disruptions, tampering with or altering system information, or uploading fake, false, or illegal data into Talata’s systems.
5.3 Users are not allowed to interact with or use Talata’s computer systems and databases in unauthorized ways, such as downloading or posting content through methods not approved by Talata.
5.4 Talata prohibits the use of automated tools like robots, phishing, spiders, scrapers, and crawlers, or any actions that negatively affect its systems.
5.5 Users cannot collect, modify, forward, or misuse information or user data from Talata’s website, application, or systems without permission.
6. Intellectual Property
6.1 Talata, including its affiliates, exclusively owns all intellectual property associated with its platform. This includes text, images, animations, audio, content, and software. Additionally, Talata’s trademarks, service marks, trade names, patents, and related intellectual property rights are legally protected under applicable intellectual property laws.
6.2 Users are strictly prohibited from copying, reproducing, imitating, falsifying, modifying, distributing, selling, renting, or otherwise misusing Talata’s intellectual property without explicit authorization. Any unauthorized use constitutes a legal violation and may result in immediate legal action, including criminal prosecution. Talata reserves the right to enforce its rights against any infringement.
6.3 Talata retains ownership of all copies of its applications and content, even after they are installed on mobile devices or other platforms. Users are granted only a limited right to access and use Talata’s services in accordance with its terms.
7. Platform Role & User Responsibility
7.1 Talata operates solely as an online platform facilitating direct communication between buyers and sellers. It does not intervene in transactions or act as a middleman in any way.
7.2 Talata does not establish legal relationships such as agency, employment, or partnership with users. It does not influence transactions, recommend users, or take any share of transactions.
7.3 All listings, product details, and transaction-related matters are the sole responsibility of the users who post them. Talata does not guarantee product quality, accuracy of listings, or fulfillment of agreements between users.
7.4 While Talata implements secure systems in line with industry standards, it does not assume liability for the accuracy of user-posted information, transaction failures, or disputes between users. Talata is not responsible for any losses, damages, or disputes resulting from fraudulent transactions, scams, or misrepresentation by users. Users acknowledge that they transact at their own risk and should take appropriate precautions before making payments or sharing sensitive information. Talata is not liable for compensation, refunds, or reimbursement for any fraudulent activity or disputes arising between users.
8. User Content
Our services allow you and other users to create, post, store, and share content, including but not limited to messages, text, photos, videos, graphics, software, logos, job descriptions, and other materials (“User Content”). Except for the license granted below, you retain full rights to your User Content, between you and Talata.
You grant Talata a perpetual, irrevocable, non-exclusive, royalty-free, worldwide, fully paid-up, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and display your User Content and any associated name, username, or likeness provided in connection with your content across all media channels, now known or developed in the future, without compensation to you. The use of your or any other user’s name, likeness, or identity within Talata services does not imply endorsement unless explicitly stated. When posting or sharing User Content on our platform, you understand that your content, along with associated information (such as your username or profile photo), may be visible to others. By providing User Content through these services, you may be sharing your content with third parties.
You are prohibited from creating, posting, storing, or sharing any User Content that violates these Terms or that you do not have full rights to grant us the necessary license. You represent and warrant that your User Content, and our use of it as permitted by these Terms, will not infringe on any rights or cause harm to any person or entity. You agree not to (and not to authorize any third party to) post, upload, transmit, distribute, store, or share any User Content that:
- Is unlawful, defamatory, obscene, pornographic, indecent, harassing, threatening, invasive of privacy or publicity rights, or inflammatory;
- Is fraudulent, misleading, false, or encourages deceptive activity;
- Is disrespectful, inappropriate, or could harm Talata, its users, or others;
- Infringes on intellectual property, privacy, or proprietary rights;
- Encourages criminal activity or violates any laws;
- Contains statements that do not reflect your honest views and experiences;
- Includes unsolicited marketing, political campaigns, or advertising;
- Contains private third-party information, including addresses, phone numbers, or payment details;
- Contains viruses, corrupted files, or other harmful content.

Talata does not monitor User Content actively and does not endorse it. While we are not obligated to screen, edit, or monitor content, we reserve the right to remove or delete User Content at any time, for any reason, with or without notice.
9. Payments and Promotions
Talata offers an optional paid service called Promote Listing, which increases the visibility of your listing on the Talata marketplace. Promoted Listings will be identified with a specific Promoted badge and may receive enhanced exposure across the Talata marketplace.
Purchasing a Promote Listing is optional and does not guarantee a sale, buyer inquiries, messages, or that you will sell or rent the item. Promote Listing does not guarantee a fixed position, first placement, or permanent visibility in search results or category pages. When multiple sellers use Promote Listing at the same time, Talata may determine the order and display of promoted listings based on marketplace conditions, relevance, listing quality, activity, location, competition, and Talata’s ranking systems.
A Promote Listing is activated only when the associated listing reaches Active status. If your listing has already been approved and is Active at the time of payment, the promotion will begin immediately. If your listing is still under moderation, your promotion will remain in a pending activation state and will automatically activate once the listing is approved and becomes Active. The promotion period does not begin or count down while the listing is under moderation or otherwise not Active.
If you edit an Active listing, your changes may be subject to moderation. During this review period, the current approved version of your listing will remain visible, and any active Promote Listing will continue without interruption until the updated version is approved.
Talata reserves the right to prevent, delay, suspend, or deactivate a Promote Listing if the listing does not comply with Talata’s Terms, Community Guidelines, applicable laws, or marketplace requirements. No refund will be provided where a promotion is suspended or removed due to the seller’s violation.
A Promote Listing automatically ends when the purchased promotion period expires or if the listing is marked as Sold, is deleted by the seller, is removed for violating these Terms or the Community Guidelines, or if the associated user account is suspended or terminated. Users cannot manually cancel an active Promote Listing. Once a Promote Listing ends for any of these reasons, any remaining promotional period is forfeited and no refund or credit will be provided.
Promote Listing purchases are linked to the specific listing for which they were purchased and cannot be transferred, exchanged, or applied to another listing or account.
All fees for Promote Listing are displayed before payment is completed. A Promote Listing purchase is considered completed only after Talata confirms successful payment. If payment is unsuccessful, incomplete, reversed, disputed, or not received by Talata, the Promote Listing will not be activated.
By purchasing a Promote Listing, you authorize Talata or its authorized payment providers to process payment using your selected payment method.
Talata currently accepts the following payment methods:
- PromptPay
- Debit Card
Talata may add, remove, or change supported payment methods at any time. Talata also reserves the right to modify the pricing of Promote Listing at any time. Any price changes will not affect purchases that have already been completed. Any applicable taxes or government-imposed charges are the responsibility of the user, where required by law.
Unless required by applicable law, all purchases of Promote Listing are final and non-refundable once the promotion has been activated.
Refunds or credits will not be provided if:
- the listing does not sell or rent;
- the listing receives fewer buyer inquiries or messages than expected;
- you change your mind after purchase;
- the listing is marked as Sold;
- the listing expires;
- the listing is deleted by you;
- the listing is removed for violating these Terms or the Community Guidelines;
- your account is suspended or terminated.
Talata may, at its sole discretion, issue a refund if a technical error prevented the Promote Listing from being delivered, you were charged more than once for the same purchase, or where required by applicable law.
If you believe you are eligible for a refund due to a service failure on our end, please contact us at support@talata.co.th and include:
- Your Talata username
- The Listing ID and Order ID
- A description of the issue
We will review your request and respond within 7 business days.
Talata will make reasonable efforts to provide Promote Listing services but does not guarantee that the service will always be available, uninterrupted, or error-free due to maintenance, technical issues, system updates, or circumstances beyond Talata’s reasonable control.
To the fullest extent permitted by applicable law, Talata shall not be liable for any loss of sales, business opportunities, lost profits, or any indirect, incidental, special, or consequential damages arising from the use of Promote Listing. Purchasing a Promote Listing provides enhanced visibility only and does not guarantee any commercial outcome.
